Introduction
These Terms of Use (“Terms”) govern access to and use of the LuxoEstates platform, available at www.luxoestates.com (the “Platform”).
The Platform is operated by Solid Iberia, S.L., CIF B93280071, with registered address at Av. Ricardo Soriano 72B – 1º, 29602 Marbella, Spain (“Operator”).
By accessing, registering, or using the Platform, users (“Users”, “Collaborators” or “Agents”) agree to be bound by these Terms.
1. NATURE OF THE PLATFORM
Luxo Estates is not a real estate agency, brokerage, or intermediation service.
The Platform operates as an open, free-use, collaborative digital environment, inspired by open-source and community-driven principles, designed to:
- Promote luxury real estate properties internationally
- Facilitate visibility and exposure of listings
- Enable voluntary collaboration between Users
Luxo Estates does not participate in, negotiate, or intermediate transactions between parties.
2. PLATFORM PURPOSE
The Platform is intended for:
- Marketing and promotional dissemination of real estate assets
- Lifestyle positioning and branding of properties and destinations
- Voluntary cooperation between Users
Content published on the Platform may serve advertising, informational, or lifestyle purposes only, and does not constitute a binding commercial offer.
3. ELIGIBILITY AND ACCESS
Access to the Platform is open; however:
- Users publishing property listings must have legal authority to do so
- Luxo Estates may, at its discretion, request identity or business verification
- Use of the Platform is permitted to:
• Real estate professionals
• Agencies
• Authorized representatives
• Individuals acting in a non-commercial, lifestyle, or community capacity
Users are not required to maintain an active commercial real estate business, provided their activity complies with applicable laws.
4. USER STATUS AND ROLE
Users acknowledge and agree that:
- They act independently and not as representatives of LuxoEstates
- Their participation may be professional, promotional, or lifestyle/community-based
Nothing in these Terms creates an agency relationship, partnership, joint venture, or employment relationship.
5. USER RESPONSIBILITIES
Users are solely responsible for all content and activity on the Platform.
Users must ensure:
- Accuracy, completeness, and truthfulness of all information
- Legal right and authorization to market or promote properties
- Compliance with applicable laws and regulations
- Respectful and professional conduct
Users must not engage in fraudulent, misleading, or unlawful practices.
6. CONTENT POLICY
LuxoEstates reserves the right to review, edit, restrict, or remove any content and suspend or terminate access.
This includes content that:
- Contains false or misleading information
- Violates laws or regulations
- Infringes third-party rights
- Damages the platform’s reputation
7. PLATFORM AVAILABILITY
The Platform is provided on an “as is” and “as available” basis.
LuxoEstates may modify, suspend, or discontinue services at any time without prior notice and without liability.
8. DISCLAIMER OF LIABILITY
LuxoEstates acts solely as a technology and marketing platform and is not involved in transactions.
It is not liable for disputes, accuracy of listings, or any losses arising from use of the Platform.
9. NO INTERMEDIATION
LuxoEstates does not act as a real estate intermediary, broker, or agent.
All transactions occur outside the Platform and are the sole responsibility of the parties involved.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Spain.
Any disputes shall be subject to the jurisdiction of the courts of Marbella, Spain.
11. MODIFICATIONS TO TERMS
LuxoEstates reserves the right to modify these Terms at any time.
Continued use of the Platform constitutes acceptance of any updates.
